Indicted Campos and Elie Strike Back at DOJ

Two of the original 11 defendants in the Black Friday indictments, one vice-chairman of a Utah bank and a payment processor filed multiple filings today disputing the basis for the DOJ's charges.

Essentially...

1. Poker is a game of skill that is exempt from UIGEA, even US government doesn't have clarity or any test that determines otherwise.

2. Poker sites aren't gambling in traditional sense as site takes rake and doesn't benefit or have edge over players playing each other.

3. New York doesn't have standing for charges against offshore companies that only took bets from NY citizens and activity occurred elsewhere.

4. Bank fraud charges are faulty because no party was harmed in the process. The bank, processors and customers all benefited.
